Acoustic Rainbow - Sample Contract

The following is a copy of the Acoustic Rainbow contract artists and labels sign before appearing on a volume sent to radio. It allows the ARTIST to retain all rights to the song and confirms that the sampler will NOT be sold in any fashion.

(NOTE: This is for review only. To receive a contract an artist MUST submit their music for review first. Only artists who been reviewed and approved by the Acoustic Rainbow Production Committee will be issued contracts.)

The Undersigned (hereinafter referred to as ARTIST) contracts with PoetMan Records USA, Inc. (hereinafter referred to as PRODUCER) to place the song, on the next available issue of the Acoustic Rainbow Radio Sampler. The ARTIST declares to have full rights and clearance and are the legal owner of the master, submitted on DAT or CD format, and grants PRODUCER all rights to present the song to radio on the Acoustic Rainbow Radio Sampler.

It is understood by both parties that the song will be used one time only, and exclusively for radio promotion. At no time will the Acoustic Rainbow Radio Sampler be available for resale and radio stations will in fact receive the Acoustic Rainbow Radio Sampler free of charge.

The PRODUCER retains all rights to mastering, sequence and final selection of musical production to be presented on the Acoustic Rainbow Radio Sampler.

The PRODUCER is granted full permission by the ARTIST to use the Artist name and/or likeness solely in conjunction with the Acoustic Rainbow Radio Sampler.

The PRODUCER retains absolute right and discretion with regards to which radio stations are presented with the Acoustic Rainbow Radio Sampler. The ARTIST will receive a complete mailing list, in the form of printed mailing labels, of radio stations which received the issue of the Acoustic Rainbow Radio Sampler on which the Artist's work appears.

The ARTIST confirms that the PRODUCER is not obligated for any royalties (production, mechanical or royalties in any other form whatsoever) for placing the submitted MASTER on the Acoustic Rainbow Radio Sampler. If the submitted MASTER is based on a song that the ARTIST does not solely own, then any song royalties, if due, are the sole responsibility of the ARTIST (based on no more than 2,000 CDs pressed for promotion) and the ARTIST holds the PRODUCER harmless for any liabilities incurred.

The PRODUCER agrees to the following:

a) To produce, master, and manufacture a CD containing the submitted master from the ARTIST upon receipt of a completed application form, application fee and signed contract.

b) To pay for and hold the ARTIST harmless for all costs incurred to manufacture, distribute and promote the Acoustic Rainbow Radio Sampler to radio.

c) To assemble all radio responses and forward such to the ARTIST for review.

d) To provide two (2) copies of the Acoustic Rainbow Radio Sampler containing the master to the ARTIST.

The ARTIST agrees to the following:

a) To submit to the PRODUCER a finished, mixed MASTER on CD (compact disc) containing the song listed above. The ARTIST will send the MASTER via OVERNIGHT MAIL to ensure the safety and security of the MASTER. The PRODUCER is not liable for the condition of the MASTER upon its arrival.

b) To send the MASTER to PoetMan Records USA Inc, 535 W. 2nd Street, suite #L-102, Lexington KY 40508.

c) To remit the sum of $695 (USA) payable to POETMAN RECORDS USA INC. in the form of a certified check, credit card or money order. There are no further charges for the sampler inclusion and payment must be received within 10 business days of this contract to guarantee placement on the next Acoustic Rainbow Radio Sampler. This agreement is governed by the laws of the Commonwealth of Kentucky.
